With the publication of the long-awaited <strong>Regulation on Administrative Cancellation Actions<\/strong> on 15 March 2025, the framework and practical steps have now been clarified. Below is an overview of the <strong>current process, requirements, timelines, and fee rules<\/strong> applicable under the new system.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>1. Filing an Administrative Cancellation Request<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cancellation requests are filed directly with the <strong>TPTO<\/strong> and must target a <strong>single trademark<\/strong> per application.<\/li>\n\n\n\n<li>The request must indicate the exact <strong>legal grounds<\/strong> (article\u2013paragraph\u2013clause) relied upon.<\/li>\n<\/ul>\n\n\n\n<p><strong>Available grounds for cancellation:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Non-use<\/li>\n\n\n\n<li>Becoming generic<\/li>\n\n\n\n<li>Misleading use<\/li>\n\n\n\n<li>Violation of technical specifications (collective\/guarantee marks)<\/li>\n<\/ul>\n\n\n\n<p>If the applicant requests the decision to be effective <strong>retroactively<\/strong>, the desired effective date must be clearly stated.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. Eligibility &amp; Preliminary Examination<\/strong><\/h2>\n\n\n\n<p>A request is automatically rejected if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The trademark is <strong>not registered<\/strong> on the filing date<\/li>\n\n\n\n<li>The registration has <strong>expired<\/strong><\/li>\n\n\n\n<li>In non-use actions, the trademark has <strong>not completed five years<\/strong> of registration in T\u00fcrkiye<\/li>\n<\/ul>\n\n\n\n<p>For retroactive-effect requests, the TPTO verifies whether the trademark was registered on the proposed effective date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Evidence Requirements for Non-Use Actions<\/strong><\/h2>\n\n\n\n<p>For non-use cancellations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The trademark must have been registered in T\u00fcrkiye for <strong>at least 5 years<\/strong>.<\/li>\n\n\n\n<li>The owner must prove <strong>genuine use in T\u00fcrkiye<\/strong> or present <strong>justified reasons for non-use<\/strong>.<\/li>\n\n\n\n<li>Any use within <strong>three months before the filing date<\/strong> is disregarded.<\/li>\n<\/ul>\n\n\n\n<p>If sufficient evidence is not submitted within the deadline, the TPTO accepts the cancellation request.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>Note:<\/strong> A cancellation decision cannot extend to <strong>similar goods\/services<\/strong>; it only covers those explicitly requested.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. TPTO Review, Responses &amp; Deadlines<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Deficiencies<\/strong><\/h3>\n\n\n\n<p>If the request is incomplete, the applicant has <strong>1 month<\/strong> to correct the deficiencies.<br>Failure to correct results in <strong>rejection with no refund<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Trademark Owner\u2019s Response<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>1 month to submit counterarguments and evidence<\/li>\n\n\n\n<li>Optional 1-month extension upon request<\/li>\n\n\n\n<li>Late submissions are not considered<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Additional Requests by TPTO<\/strong><\/h3>\n\n\n\n<p>If necessary, TPTO may request further documents or explanations with an additional 1-month deadline.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Withdrawal of a Cancellation Request<\/strong><\/h2>\n\n\n\n<p>Applicants may withdraw their request <strong>before the decision<\/strong> is issued.<br>A signed form and Power of Attorney (if applicable) must be submitted to TPTO.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. Fee Structure &amp; Escrow System<\/strong><\/h2>\n\n\n\n<p>Each cancellation request includes two components:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Official Fee<\/strong><\/li>\n\n\n\n<li><strong>Escrow Fee<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The TPTO handles escrow payments as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>If the request is fully rejected:<\/strong> escrow fee is payable to the trademark owner<\/li>\n\n\n\n<li><strong>If fully accepted:<\/strong> escrow fee is returned to the applicant<\/li>\n\n\n\n<li><strong>If partially accepted:<\/strong> no refund to either party; escrow is transferred to TPTO revenue<\/li>\n<\/ul>\n\n\n\n<p>Escrow fees unclaimed within <strong>10 years<\/strong> from the final decision become TPTO income.<\/p>\n\n\n\n<p>If the application is withdrawn or deficiencies are not corrected, the escrow amount is returned to the applicant upon request.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-7-preliminary-applications-before-march-2025\"><strong>7. Preliminary Applications Before March 2025<\/strong><\/h2>\n\n\n\n<p>For requests submitted before the Regulation\u2019s publication:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Applicants are given 1 month to complete missing information<\/li>\n\n\n\n<li>Payment-related changes <strong>do not apply<\/strong> to preliminary applications<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>8.
