Design Application in Turkey | Registering Industrial Designs with EFOR IP<\/h2>\n

With the new Turkish Industrial Property Law No. 6769<\/strong>, which entered into force on January 10, 2017<\/strong>, the framework for design registration and protection in Turkey<\/strong> has undergone significant changes.
The updated law modernizes the system in line with EU design regulations<\/strong>, offering both registered and unregistered design protection<\/strong>.<\/p><\/blockquote>\n

Key Updates in Turkish Design Law<\/h3>\n

The 2017 IP Law introduced major improvements that make the design application process in Turkey<\/strong> faster and more effective:<\/p>\n

    The title \u201cindustrial design\u201d has been replaced with \u201cdesign\u201d<\/strong>, broadening the scope of protection.<\/p>\n<\/li>\n

  • \n

    Registration period shortened<\/strong> from 6 months to approximately 3 months<\/strong>.<\/p>\n<\/li>\n

  • \n

    Novelty search<\/strong> is now conducted for each application by the Turkish Patent and Trademark Office (TPTO)<\/strong>.<\/p>\n<\/li>\n

    Applications contrary to public order or morality<\/strong>, or not novel<\/strong>, are automatically rejected.<\/p>\n<\/li>\n

  • \n

    Design descriptions are no longer required<\/strong>, and the scope of protection depends on the design itself.<\/p>\n<\/li>\n

    Opposition proceedings<\/strong> before TPTO are now free of official fees<\/strong>.<\/p>\n<\/li>\n

  • \n

    Unregistered designs<\/strong> receive 3 years of protection<\/strong> once disclosed publicly.<\/p>\n<\/li>\n

  • \n

    Only visible parts of complex products<\/strong> are eligible for design protection.<\/p>\n<\/li>\n

  • \n

    University researchers<\/strong> now share commercialization income for academic designs.<\/p>\n<\/li>\n

  • \n

    Civil proceedings only<\/strong> apply for design disputes \u2014 criminal actions are no longer available.<\/p>\n<\/li>\n<\/ul>\n

    Design Application Procedure in Turkey<\/h3>\n

    The design registration process in Turkey<\/strong> is conducted before the Turkish Patent and Trademark Office (TPTO)<\/strong> and includes several key stages:<\/p>\n

      Filing the Application<\/strong>
      Applicants must submit all required documents and visual representations of the design. TPTO examines whether the application meets formal standards, including clarity, dimensions, and classification.<\/p>\n<\/li>\n

    2. \n

      Formal Examination<\/strong>
      TPTO checks compliance with procedural requirements, such as the number of views, priority claims, and whether the design reflects novel and distinctive characteristics<\/strong>.<\/p>\n<\/li>\n

    3. \n

      Novelty Search and Publication<\/strong>
      After the formal check, TPTO carries out a novelty search<\/strong>.
      If the design meets the required conditions, it is published in the Official Designs Bulletin<\/strong> for a 3-month opposition period<\/strong>.<\/p>\n<\/li>\n

    4. \n

      Opposition and Registration<\/strong>
      If no opposition is filed, the TPTO issues a registration decision<\/strong> and a Design Registration Certificate<\/strong>.
      Once registered, the design owner can prevent others from using identical or confusingly similar designs in Turkey.<\/p>\n<\/li>\n<\/ol>\n

      Duration and Renewal of Design Protection<\/h3>\n

      A registered design in Turkey<\/strong> is protected for 5 years<\/strong> from the filing date.
      This protection can be renewed every 5 years<\/strong> up to a maximum of 25 years<\/strong>, as long as renewal fees are paid.<\/p>\n

      Unregistered designs benefit from 3 years of protection<\/strong> from their first disclosure date, under Article 11 of the EU Community Designs Regulation.<\/p>\n

      Required Documents for Design Application<\/h3>\n

      To file a design application in Turkey<\/strong>, the following documents are required:<\/p>\n
