Design Enforcement in Turkey
According to the Turkish laws and regulations, the holder of an industrial design is entitled to prevent the production, sale, use, or importation of the identical or significantly similar designs or keeping them in possession for purposes other than for personal needs actions by third parties performed without permission:
Here are the demands of the design owners from the IP Courts in Turkey:
- Determination of the act of infringement,
- Satisfaction and the recovery of infringement,
- Seizure of the imitated products and the machines producing these products,
- Prevention of the act of infringement,
- Return of the ownership of the seized machines and products to the owner of the registration certificate,
- Announcement of the court’s decisions on condition of the “the payment of fee by the aggressor” and
- Compensation with the material damages of the owner of the registration certificate.
